How Do Bail Bonds Work?

No CommentsWhen a person is arrested on suspicion of having committed a crime in Santa Barbara, as is the case everywhere, they will be taken to and confined in a jail cell by law enforcement agents. While waiting for the case to be tried in a court of law, the suspect will be held in the city or county jail unless he or she chooses to bail out.
So what exactly is bail and how does it work? Bail bonds are surety bonds which are used as a guarantee against the suspect fleeing before appearing in court at the scheduled date and time of his or her trial. By definition, bail is a financial arrangement between the arrestee and the bail bonding agency in accordance with which a bondsman posts bail on behalf of the suspect. The agency acts on the defendant’s behalf, and will arrange with the court to have its client released from jail until the trial date in exchange for a surety in the form of money or collateral (tangible assets). It is for the court to set the monetary value of the bail, though excessive bail is prohibited by a provision of the Eighth Amendment.
Bail bonds are considered to be a guarantee for the entire amount of the bail, though some courts will accept a cash payment of as little as 10% of the full amount to release the defendant. The main benefit of bail bonds to the client is not having to spend the duration of the time between his or her arrest and the trial date in jail.
Once the suspect is bailed out of jail, he or she is expected to abide by certain restrictions until the case is heard before a judge. This includes a prohibition against the suspect traveling outside the jurisdiction of the court. In some instances, the accused must ask for the consent of the court before he or she can travel elsewhere. Electronic monitoring or scheduled visits with law enforcement officials may be required during the interim period.
The essential thing to remember about bail bonds is that, in exchange for being freed from a jail cell, the suspect has agreed to attend all proceedings related to his or her case. Failure to comply with all the conditions set forth in the bail arrangement can lead to forfeit of the bail money and of course, what the suspect dreads the most: immediate return to a jail.

Expert Bail Bondsman

No CommentsThe subject of bail bonds is a sobering one. Life is not always smooth sailing, and everyone–even those who are lucky enough to live in a place as beautiful as Santa Barbara California–encounters rough seas at some point in their lives. These “rough seas” may even involve a run in with the police leading to arrest and incarceration in the local jail.
As I mentioned above, this is a sobering subject, so I’ve included this video as comic relief. The self-described “bail bond expert” in this clip is a real-life bail bondsman, but he did not acquire his expertise in the usual way.
